Terms of Service

These Terms of Service ("Terms") govern your use of Caipher ("Caipher," "the app," "we," "us," or "our"), an iOS application developed and operated by David Justin Madigan, an individual developer. By downloading, accessing, or using Caipher, you agree to these Terms. If you do not agree, do not use the app.

The service

Caipher is a productivity app for TikTok Shop affiliate creators. It provides tools to track and appeal violations, manage brand relationships, generate video scripts, and organize a connected email inbox, along with an AI assistant. Features may change, expand, or be removed over time as the app develops.

Eligibility

You must be at least 18 years old to use Caipher. By using the app, you represent that you meet this requirement and that the information you provide is accurate.

Your account

You are responsible for maintaining the security of your account and for all activity that occurs under it. If you sign in using Apple or Google, your use of those services is also subject to their respective terms. Notify us promptly at djmadigan@pm.me if you believe your account has been compromised.

Acceptable use

You agree not to:

  • Use Caipher for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorized access to the app, its systems, or other users' data
  • Interfere with or disrupt the app's operation or servers
  • Use the app to store or transmit content that infringes the rights of others
  • Reverse engineer, resell, or redistribute the app except as permitted by law

We may suspend or terminate your access if you violate these Terms.

Connected accounts and third-party services

Caipher lets you connect third-party accounts, such as Gmail, and relies on third-party providers including Supabase, Google, Apple, and Anthropic to deliver its features. Your use of those connected services and providers is subject to their own terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

AI-generated content

Caipher uses artificial intelligence to generate content such as scripts, drafts, classifications, and suggestions. AI output may contain errors or inaccuracies and is provided to assist you, not to replace your own judgment. You are responsible for reviewing and deciding how to use any AI-generated content. We make no guarantee that AI output is accurate, complete, or suitable for any particular purpose.

Your content

You retain ownership of the content you create or provide in Caipher. By using the app, you grant us the limited right to store and process that content solely to provide the app's features to you, as described in our Privacy Policy.

Subscriptions and payments

Caipher may offer paid subscription features. If and when paid features are offered, pricing, billing, and renewal terms will be presented to you at the point of purchase and processed through the Apple App Store, subject to Apple's terms. Any future changes to pricing will be communicated in advance.

Disclaimers

Caipher is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure, or that any result obtained through the app will be accurate or reliable.

Caipher is an independent tool and is not affiliated with, endorsed by, or sponsored by TikTok, Google, Apple, Anthropic, or any brand referenced within the app.

Limitation of liability

To the fullest extent permitted by law, David Justin Madigan will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of Caipher. Our total liability for any claim relating to the app will not exceed the amount you paid to use it, if any, in the twelve months preceding the claim.

Termination

You may stop using Caipher at any time. We may suspend or terminate your access to the app at any time, with or without notice, if you violate these Terms or if we discontinue the service. Upon termination, the provisions of these Terms that by their nature should survive will continue to apply.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of Caipher will be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you within the app. Your continued use of Caipher after changes take effect constitutes acceptance of the updated Terms.
